The Children’s Internet Protection Act was signed into law by former President Bill Clinton in 2000, requiring schools and libraries to block visual depictions that contain or are (1) obscene, or (2) child pornography, or, with respect to use of computers with Internet access by children, (3) harmful to minors. An authorized individual may disable the blocking or filtering system for use by an adult to enable access for bona fide research or other lawful purpose.
These new laws place restrictions on the use of funding that is available through the Library Services and Technology Act, Title III of the Elementary and Secondary Education Act, and on the Universal Service discount program known as the E-rate (Public Law 106-554). Under CIPA, libraries and schools must show that the filters are installed to receive an education rate, or e-rate, funding. The e-rate program is designed to help wire the nation's 84,000 public schools and 16,000 public libraries.
CIPA compliance requires more than simply implementing a content filtering solution. Schools need to develop an "Internet Safety Policy" that addresses a broad range of issues, from hacking, chat room and e-mail safety to the protection of students personal online information. In order to be eligible for E-rate funding, school and library authorities must certify that they have adopted and implemented an Internet safety policy addressing the following:
- Access by minors to inappropriate matter on the Internet and World Wide Web;
- The safety and security of minors when using electronic mail, chat rooms, and other forms of direct electronic communications;
- Unauthorized access, including so-called “hacking,” and other unlawful activities by minors online;
- Unauthorized disclosure, use, and dissemination of personal information regarding minors;
- Measures designed to restrict minors’ access to materials harmful to minors.
